
Shadow Lake Zebra Mussel Rules
1. As used herein "Watercraft" shall mean motorboats, sailboats, johnboats, pontoons, skiffs, row boats, canoes, kayaks, kick boats, or any other type of vessel or flotation apparatus designed to carry one or more persons.

2. As used herein "Restricted Use Watercraft" shall mean any
Watercraft that will be used on Shadow Lake exclusively, and will not be launched on any other body of water for the duration of the Permit issued pursuant to these Rules and other community directives.

3. "Non-Restricted Use Watercraft" shall mean all Watercraft
other than Restricted Use Watercraft.

4. As used herein "Resident" shall mean any person residing within the jurisdiction of Cedar Creek Community Services Corporation, Inc. (hereinafter the "CCCSC") and Cedar Creek Homes Associations (hereinafter the "HOA") by virtue of ownership of, or residing in, a Residential Unit as that term is defined in the Amended and Restated Declaration of Covenants for the Cedar Creek Community dated June 20, 1996, and amendments thereto.
5. No Watercraft of any kind shall be launched or used on
Shadow Lake by any person unless it has a valid Lake Use Permit issued by the HOA. The Lake Use Permit must be attached to the left (port) side of the stern.

6. No Lake Use Permit shall be issued by the HOA unless the
Acknowledgement of Zebra Mussel Infestation Prevention Rules is signed by the Residential Unit Owner. Lake Use Permits shall only be issued to Residential Unit Owners of record, and may not be given or loaned to other persons.
7. Restricted Use Watercraft will be permitted on Shadow
Lake only under the following conditions:
a. The Resident Unit Owner agrees that the Restricted
Use Watercraft will be used on Shadow Lake
exclusively, and will not be launched on any other body of water, for the duration of the Permit.
b. A valid Lake Use Permit is issued for such Restricted
Use Watercraft.
c. Prior to the first launch onto Shadow Lake after
obtaining a new Lake Use Permit, the Restricted Use Watercraft, including its trailer, must be:
i. Thoroughly cleaned by removing all plants,
animals, mud and thoroughly washed, including all crevices and hidden areas.
ii. Thoroughly drained of all water, including live or bait wells, piping, ballasts and engine cooling water; and
iii. Thoroughly dried for a minimum of fifteen (15)
days.
d. The requirement of subparagraph c, above, may be waived if the Residential Unit Owner affirms that the Restricted Use Watercraft has been exclusively used only on Shadow Lake and has not been launched on any other body of water for the six (6) month's prior to
applying for the Lake Use Permit, or that the Restricted Use Watercraft is new and has not be in contact with
any body of water.
8. Non-Restricted Use Watercraft will NOT be permitted on
Shadow Lake under any circumstances.
9. All Lake Use Permits will expire on December 31st of the
year they are issued.
10. Access to the boat ramp at Shadow Lake is limited by an electronic gate and FOB system. For Watercraft that require the use of the boat ramp for launching into Shadow Lake, a FOB will be issued to the Resident Unit Owner. No resident shall give or lend the FOB to any person. The sanctions outlined in #12 below will be imposed for any violation of these provisions.
11. The use of baitfish and other live aquatic bait for fishing in Shadow Lake is strictly prohibited. Any violation of this rule will result in the imposition of sanctions outlined in #12 & #13 of these rules.
12. Violation of any of these Rules will result in forfeiture of boating and fishing privileges on Shadow Lake of all Residents residing at the Residential Unit at which the violator resides, as well as fines imposed from $500 to $5,000 on the Resident. Such fines, if not paid within thirty (30) days from Final Imposition, shall become a lien upon the Residential Unit. "Final Imposition" shall mean upon final determination after all appeals to the Covenants Committee, and if applicable, the Board of Directors, have been exhausted.
13. Any person, including any Resident, that by their actions
cause zebra mussel infestation in Shadow Lake, will also be subject to liability for the damages caused thereby.
14. The HOA will post the following at the Shadow Lake boat
ramp:
Only Watercraft with Cedar Creek Homes Association Lake Use Permits are allowed on this lake. Operators of any Watercraft without such a Permit will be charged with criminal trespass.
